O ur mission at Mach5 Performance is to build life long relationships with our customers. To do so, we strive to offer the best products to our customers as quickly as possible, with the best customer service experience in our industry. We realize that there will be times when returns are necessary. As such, if an issue with one of the products you have purchased from us does arise, our goal is to make the return or exchange as simple as possible. To achieve this goal, we have provided herein the Terms & Conditions that govern our sales and any resulting returns or exchanges of those products sold. Failing to understand and adhere to our Terms & Conditions may result in the forfeiture of the ability to obtain refunds, process exchanges, or obtain repairs or replacement products. Accordingly, please take the time to read and understand our Terms & Conditions carefully as they are binding on both the Customer and Mach5 Performance.

Note : Many parts are for off-road use only. As with any racing activity, there are risks when performing performance modifications. All installations are at the customers own risk.Mach5 Performance or www.Mach5-Performance.com holds no responsibility either implied or otherwise for mechanical, electrical or other failure when using after market products. Some items listed are illegal in many states and only for racing vehicles which may never be used on a public highway.

Conditions of USE

Your use of this site indicates your acceptance of these terms and conditions. Your placement of an order indicates your acceptance of these terms and conditions.

All content included on this site, such as text, graphics, logos, button icons, images, audio clips and software, is the property of Mach5 Performance or its suppliers/manufacturers and is protected by U.S. and international copyright laws. All trademarks, service marks, and trade names of and related to Mach5 Performance are proprietary to Mach5 Performance. All other trademarks not owned by Mach5 Performance or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Mach5 Performance. Product information such as text, logos, and/or images used to promote products and/or the sale of products have been provided to Mach5 Performance along with permission to use directly from the supplier or manufacturer. Any unauthorized use from other companies of the materials appearing on this site without written permission from the supplier and/or manufacturer may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. All software used on this site is the property of Mach5 Performance or its software suppliers and protected by U.S. and international copyright laws and may not be reproduced, modified, distributed, transmitted, or republished.

Receiving an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Mach5 Performance reserves the right at any time after receipt of your order to accept or decline your order for any reason. Mach5 Performance reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item and adjust your invoice accordingly. Mach5 Performance may require additional verifications or information before accepting any order. Once you have placed an order online, by phone, or through any other method with Mach5 Performance, you have entered into a contract to purchase, and your credit card will be charged immediately. Orders do not always ship the same day. Please allow 24 hours for your order to be processed. Some areas or international orders may require up to 48 hours. If you need priority delivery, please contact us by phone for immediate attention. For custom-made orders, we will inform you of the production schedule via email, and the production time will be based on our notification.

Because Mach5 Performance reserves the right to accept or decline your order for any reason, typographical, product photo, and/or pricing errors that may occur do not entitle a customer to receive products based on those errors. Mach5 Performance cannot be held responsible for honoring purchases caused by such errors and will simply take action to correct the mistake. These errors do not constitute a misrepresentation of a product, business, manufacturer, or sale, but rather are errors that Mach5 Performance is responsible for correcting.

User Submissions

The personal information you submit to Mach5 Performance is protected by our privacy policy. In the event of any inconsistency between these Terms and the Privacy Policy, the Privacy Policy shall govern.

By voluntarily providing your phone number and/or email address to Mach5 Performance, you consent to Mach5 Performance contacting you via SMS (see terms), MMS, or email, and you agree to receive such communications for transactional, operational, or informational purposes. You understand and agree that text messages and emails may be sent to you using automated technology. You can unsubscribe from receiving SMS messages from Mach5 Performance at any time by replying “STOP” to the text messages. If you need assistance, please reply to our emails. We rarely send SMS messages to you proactively. If you unsubscribe from Mach5 Performance’s SMS messages, you may continue to receive them briefly while Mach5 Performance processes your request. When you provide any phone number to Mach5 Performance, you warrant that you are the current subscriber or authorized user of that phone number. If you change, forfeit, or deactivate the phone number you provided to Mach5 Performance, you agree to notify us immediately. Failure to do so constitutes a material breach of these Terms.

By submitting content, you agree that the submission is non-confidential, non-proprietary, and may be disseminated or used by Mach5 Performance. If you submit content, you automatically grant—or warrant that the owner of such content has expressly granted—Mach5 Performance a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the submission in any media or medium, or any form, format, or forum now known or hereafter developed. However, Mach5 Performance is not obligated to use any submission.
You are solely responsible for your submission, the consequences of making a submission, and your reliance on any submissions. Mach5 Performance is not responsible for the consequences of any submission. Mach5 Performance does not screen or monitor submissions made by users to the services. If notified by a user of a submission allegedly in violation of these terms, Mach5 Performance may investigate the allegation in good faith and at its sole discretion determine whether to remove such submission. Mach5 Performance will have no liability or responsibility to users for performance or non-performance of such activities.

Ordering Procedure

If you order a product, your payment will be processed immediately. We will notify you of the order status and product availability. If you choose to cancel an item that is not classified as a special order, we will do our best to accommodate your request but do not guarantee cancellations after the order is placed. For special order or personalized items, cancellations are generally not accepted, and you may lose your deposit.

Special Orders

Customer acknowledges that if this purchase contains a special order item, the provisions of this paragraph supersede any conflicting general terms of these terms and conditions.

Product(s) classified as special order cannot be cancelled or returned for any reason. By using our digital confirmation link you agree to all terms and conditions associated with our website and hold harmless Mach5 Performance against all suits at law or in equity and from any and all damages, claims, and demands for personal injury or actual or alleged infringement of any United States or foreign intellectual property right and to defend any suit or actions which may be brought against Mach5 Performance for such injury and/or any alleged infringement because of the manufacture and/or sale of the material covered thereby. All special ordered Products are subject to a cancellation fee of 100% of the purchase price if cancelled at any time after placed.

Order Cancellations

We will allow the cancellation of non-custom or special order item(s) that have not been shipped and are not marked as non-cancelable / non-refundable items. Items that have already been shipped cannot be canceled or modified. Cancellations can be requested by contacting our customer service team who can be reached via live chat or phone through the Mach5 Performance website. Cancellation requests will be processed as quickly as possible.

Shipping Rates

The Shipping Rates shown at time of checkout are estimates only. We encourage you to contact us for a special shipping quote. If there is an error in the shipping rate quoted we will contact you and let you know of the changes. International orders ( Outside the Taiwan / China ) are not automatically processed as we may require additional information from you.

Typographical Errors

In the event an item is listed at an incorrect price or with incorrect information on our website due to typographical error or an error in pricing or product information received from our suppliers, Mach5 Performance shall have the right to refuse or cancel any orders placed for such items listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed or we have received payment. In such a case, if you have already paid and your order must be canceled, we will issue a refund to you via your original method of payment as defined herein.

Defective, damaged, or incorrect products

While Mach5 Performance strives to ensure that the products are a perfect fit, in pristine condition, and properly suited for use upon first delivery, there may be instances due to factors beyond our control where products could be damaged in transit, defective from the assembly line, or otherwise incorrect.

If your items arrive defective, damaged, flawed, or incorrect, please do not attempt to use, install, modify, or repair the product. Contact our customer service team immediately, and they will help you find the best solution.

For exchanges or replacements, once you have contacted our customer service team, they will work with you to facilitate the transaction. During this process, you may be asked to provide photos or videos of the damage, defect, or fitment issues to accurately process your request.

In such cases, we will provide you with a prepaid return label to return the defective part. Upon return, we will inspect the part and, upon confirming the defect and determining that the issue is not caused by the customer, process an exchange or replacement.

Products must be returned within 30 days of delivery (note that this 30 days is calculated from the time you receive the product and does not include shipping time, to avoid issues with sea freight impacting this term). If the damage was caused by the shipping courier, we will arrange for the courier to pick up the damaged item. Please note that products must be in their original packaging, and additional requirements may apply for products shipped via freight carriers, which our customer service team will discuss with you.

Please be advised that returns, refunds, or exchanges under this section do not apply to warranty claims. Warranties on items are provided by their manufacturers, and each manufacturer’s time frames and terms and conditions vary. MACH5 PERFORMANCE DOES NOT REFUND SHIPPING CHARGES.

If you modify, install, or alter the item in any form, we cannot accept it as a return, will not cover any expenses related to the product or installation, and you maybe be required to purchase a replacement.

International Shipping

All international shipments may be subject to customs fees, import duties, and taxes. Any charges associated with the importation of products purchased from Mach5 Performance or our affiliates are the responsibility of the buyer. Any costs resulting from the refusal to import a product purchased through Mach5 Performance or our affiliates may result in additional charges.

Payment Terms

Mach5 Performance currently accepts PayPal payments. In the future, we will support credit cards, Affirm, Amazon Pay, and bank transfers, provided that appropriate billing and shipping addresses are provided. For international orders, please wait for us to contact you to confirm your order details before proceeding with payment. Billing and shipping information may need to be verified according to local tax authority requirements. Unless otherwise notified, all orders must be paid in full at the time of purchase. Prices and shipping costs are subject to change at any time due to exchange rates, shipping costs, manufacturer price changes, etc.

Warranty

If any non-Mach5 Performance brand products purchased from mach5-performance.com come with a warranty, it is provided directly by the manufacturer of the product. Warranty claims must be handled by the manufacturer. Mach5 Performance does not handle warranty claims and is not responsible for product failures or failures due to installation issues. However, please note that exhaust systems manufactured by Mach5 Performance are covered by a warranty provided by Mach5 Performance.

Certain products are intended for race use only, and the manufacturer recommends that these products be installed and set up by professional service centers only. As stated above, we are not responsible for shipping costs other than those due to our own shipping errors. Any item that has been altered or modified from its original state will not be eligible for return or warranty support.

By law, a dealership cannot void a warranty solely because aftermarket parts are installed on a vehicle. When you add an aftermarket part to the vehicle, it will void the warranty of the original part it replaces.

Warranty Terms for Third-Party
Wheels Sold by Mach5-Performance.com

Please note that Mach5 Performance is a registered trademark, and Mach5-Performance.com is an online platform primarily for selling and showcasing Mach5 Performance exhaust systems. We also recommend and sell third-party products, including third-party brand wheels. These wheels come with a limited lifetime warranty provided by the manufacturer, covering structural issues caused by manufacturing defects that make the wheel unsuitable for its intended use. Damage or issues not directly resulting from manufacturing defects are not covered by any warranty offered by Mach5-Performance.com. Mach5-Performance.com reserves the right to deny warranty coverage in the following cases:

  • Wheels mounted on vehicles exceeding the wheel's load rating.
  • Wheels that have been modified in any way.
  • Acts of nature or misuse.

Mach5-Performance.com does not provide road hazard protection and will not cover issues resulting from collisions, potholes, or debris.

Mach5 Performance Tuned ECU Flash Terms

All software services (including remote tuning and technical support) are final sales and non-refundable after purchase. Mach5 Performance provides unique software calibrations for specific vehicle applications and is not responsible for misuse or vehicle behavior resulting from installation errors or mechanical issues. Mach5 Performance will offer support, including remote diagnostics, to determine the next steps. End-users are responsible for vehicle maintenance and the integrity of any OEM or aftermarket parts installation. The software sold by Mach5 Performance is guaranteed to function as intended for the specific application it is provided for, but does not include or guarantee specific horsepower or torque figures.

Mach5 Performance will provide lifetime support to users who purchased directly from Mach5 Performance or an authorized dealer.

Hardware:
Tuning Hardware - Mach5 Performance collaborates with top program hardware providers, such as AutoTuner. Warranty details should be referenced in the tuning hardware package you purchased. Even if covered by the manufacturer’s warranty, damages or issues not directly caused by manufacturing defects are not covered under any warranty provided by Mach5 Performance or the device manufacturer. Mach5 Performance and the device manufacturer reserve the right to refuse warranty coverage for the following reasons:
  • Neglect.
  • Misuse.
  • Water Damage.
  • Acts of Nature
  • Personal Opinion

Please Note: To submit any warranty claim, proof of professional installation or an attempt at installation must be provided. All warranty claims must be reviewed. If approved, an RMA (Return Merchandise Authorization) number will be provided, which must be included in the packaging. If this number is not included, your return will be refused. All return shipping costs to and from Mach5 Performance are the responsibility of the customer or distributor initiating the warranty claim. If the product is determined to be covered under warranty, Mach5 Performance will repair the product to its original specifications, offer a replacement, or provide a refund to the original purchaser if necessary. Our warranty does not cover any labor, services, or related products.
